Regina v C
The Defendant appeared before the Liverpool Crown Court listed for Trial charged with possession of a Section 1 Firearm carrying a minimum sentence of 5 years' imprisonment.
The case involved expert evidence in the field of firearms and DNA being produced by the Crown Prosecution Service to confirm the firearm recovered had been converted to a Section 1 firearm, and DNA belonging to the Defendant was recovered from the said firearm.
We undertook to instruct the leading firearms expert in the country and independent DNA expert to produce reports on behalf of the defence.
The Defence experts were able to argue to the Court that the Crown could not say when the Firearm was converted or infact, when the DNA came to be on the Firearm when recovered.
The Crown Prosecution Service re-considered the evidence in the case and offered no evidence as the DNA found upon the Firearm could have been on the Firearm before it was converted.
The Judge recorded a Not Guilty Verdict.
Regina v O
The defendant appeared before the Liverpool Crown Court for Trial in relation to a serious offence of Robbery.
The Defendant was charged as a result of being identified from CCTV evidence at the scene.
The defendant argued mistaken identity stating he was not the person subject to the CCTV evidence.
We instructed the leading Facial Mapping Expert in the country who was able to prove that the male in the CCTV was not the Defendant. Further to this the Crown Prosecution Service instructed the number two expert in the country who could not challenge our defence expert’s evidence.
The Crown Prosecution Service therefore offered no evidence and the Judge recorded a Not Guilty Verdict.
